Terms of service.
These Terms govern your use of CopyThumb ("the Service", "we", "us"), operated as a sole trader registered in Morocco. By creating an account or using the Service, you ("you", "your") agree to be bound by these Terms. If you do not agree, do not use the Service. Important — your responsibility for reference content
You represent and warrant that any YouTube channel, thumbnail image, or other content you submit to the Service as a style reference is either (a) content you own, or (b) content you have explicit permission, licence, or other lawful right to use as a style reference for thumbnails you publish on your own channel. The Service extracts STYLE ELEMENTS (palette, composition, typography conventions) — which are generally not copyrightable — and applies them to your original title and brief. You remain solely responsible for ensuring the inputs you submit and the outputs you publish do not infringe any third party's intellectual property, publicity, trademark, or contractual rights. Submitting copyrighted reference content without authorisation is a breach of these Terms and may result in account suspension.
1. The Service
CopyThumb is a web application that helps creators generate YouTube thumbnails styled consistently with a reference channel. You provide a publicly available YouTube channel URL or reference image (which you must own or have rights to use — see warranty above) plus a video title; our system extracts style elements from the reference and produces new thumbnail images intended for use on your own YouTube videos. We may add, change, or remove features over time at our discretion. Material changes that reduce existing functionality on paid plans will be announced by email at least 14 days in advance.
2. Eligibility and account
You must be at least 16 years old to use the Service. By creating an account you confirm that you can lawfully enter into a binding contract. You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. You agree to notify us at support@copythumb.com of any unauthorised access to your account.
3. Plans, payment, and renewals
The Service offers a Free plan and four paid subscription tiers (Lite, Starter, Pro, Studio), plus one-off token credit packs. Current prices are listed at /pricing. Paid plans renew automatically each billing period until cancelled. Cancellation stops future renewals but does not by itself trigger a refund of a charge already made — see our Refund Policy for refund terms, including the 14-day money-back guarantee on your first paid charge.
Payment is processed by a third-party payment provider (currently PayPal, transitioning to Paddle as Merchant of Record). By purchasing a plan you also agree to the payment provider's terms applicable to your transaction. Prices are listed in US dollars; applicable taxes or VAT may be added at checkout per your region.
4. Token economy and roll-over
Subscription plans grant a monthly allowance of "tokens" that are consumed each time you generate a thumbnail. Unused subscription tokens roll over to the next billing period for as long as your subscription remains active. Tokens have no cash value, are not transferable, and expire when the account is closed. Add-on token packs do not expire while the account remains open.
5. Acceptable use
You agree not to use the Service to:
- Generate content that infringes the intellectual property, publicity, or privacy rights of any person, including unauthorised recreations of copyrighted characters, logos, or branded assets;
- Generate content that is unlawful, defamatory, obscene, sexually explicit, harassing, hateful, threatening, or that promotes discrimination, terrorism, or violence;
- Generate content depicting minors in any sexual or otherwise inappropriate context;
- Impersonate any person or misrepresent your affiliation with any entity;
- Attempt to circumvent rate limits, plan caps, watermarks, or access controls; reverse-engineer the Service; or scrape outputs to train competing AI models;
- Use the Service to support spam, malware, phishing, or any other activity that disrupts third-party services.
We may suspend or terminate accounts that violate this section, without refund of paid balances when violations are clear. We reserve the right to remove generated content from our systems that we reasonably believe violates these Terms or applicable law.
6. Intellectual property
Your inputs. You retain ownership of the channel URLs, titles, reference images, and other content you submit. You grant us a limited, non-exclusive licence to process those inputs solely for the purpose of operating and improving the Service.
Your outputs. Subject to your compliance with these Terms and your active subscription status, you own the thumbnails you generate through the Service and may use them commercially on YouTube and other platforms. You are responsible for ensuring your use of any output complies with applicable copyright, trademark, publicity, and platform-specific rules (including YouTube's).
Our platform. The Service software, branding, underlying models, and documentation are owned by us or our licensors. Nothing in these Terms transfers any right in them to you beyond the right to use the Service per these Terms.
7. Third-party content and channels
The Service can read publicly available data from YouTube channels you reference. You represent that your use of any referenced channel is permitted by applicable law and by YouTube's terms. We do not endorse, monitor, or assume responsibility for any third-party channel, video, or creator that appears in our Service or in your generated outputs.
8. Service availability and modifications
We aim for high availability but do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis. We may temporarily suspend the Service for maintenance, security updates, or to comply with applicable law. We do not provide refunds for short, isolated downtime; persistent unavailability is handled per our Refund Policy.
9. Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any specific thumbnail generated by the Service will increase your click-through rate, comply with every platform's rules, or be free of artefacts. Generated content is produced by AI models and may include inaccuracies.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50. In no event will we be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, or lost data, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold us harmless from any third-party claim, demand, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your infringement of any third party's rights through your inputs or your use of outputs.
12. Termination
You may close your account at any time from the account page or by emailing support@copythumb.com. We may suspend or close your account for breach of these Terms, for suspected fraud, or where required by law. On closure, your data is deleted per our Privacy Notice; outstanding paid balances are refunded only where required by our Refund Policy.
13. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Morocco, without regard to conflict-of-laws rules. The competent courts of the Kingdom of Morocco shall have exclusive jurisdiction over any dispute arising from these Terms, except where applicable consumer-protection laws give you the right to bring proceedings in your country of residence (in which case you retain that right).
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes affecting paid features will be announced by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
